Boozr is an advertising service that enables bars and restaurants to create a highly visual display of their liquor selection through which they can promote any events, specials, seasonal deals, etc to customers on premise. The purpose of these terms is to outline the agreement between Boozr and any party that uses the service.
Restaurants must create and maintain an account with Boozr to subscribe to the service. Subscription is free initially with a 60 day trial. Following this, restaurants must pay $35 per month to keep the service active. Payment can be made using most debit or credit cards or via ACH. Subscriptions are automatically renewed unless the restaurant decides to cancel. Restaurants are able to cancel at any time by simply toggling the switch in the billing section of settings.
Restaurants that subscribe to Boozr may add any liquor items to their menu. If a specific liquor brand requests that Boozr remove any images, Boozr reserves the right to change or remove items on the restaurant’s menu to accommodate the request. Restaurants may create any advertisements, so long as they don’t display any text or images that contain inappropriate content. Inappropriate in this context is defined as anything profane, sexual, threatening, racist, or derogatory.
Restaurants must cover any legal costs or damages arising from misuse of the service, violation of laws, or the content they publish.
Boozr monitors and records user interactions with the service. Restaurants may freely download and use any customer data collected by Boozr. This includes any scan, tap, or input data from customers. Boozr does not collect any personal or sensitive data from users unless the user willingly inputs their information into the application. Restaurants may not give out its login credentials to any other businesses. In the event that a restaurant discloses this information outside of their business, Boozr reserves the right to terminate service immediately.
Boozr will keep service available and reliable to the best of its ability. In the event that service experiences any outages, technical issues, or maintenance, we will restore service as soon as possible. Boozr does not provide any refund for service outages as they are inherently part of software businesses. Customer support will be provided to help troubleshoot issues with the display or to accommodate any requests made by restaurants to edit items or advertisements on the menu. BBoozr does not sell or profit from any sales to the restaurant that come as a result of customers interacting with the service. All content displayed on the service is owned and created by Boozr. Anything that Boozr markets or advertises for restaurants will exclusively be shown inside of the restaurant to its customers. Boozr takes appropriate measures to protect sensitive user data, but cannot guarantee absolute security. Subscribers must acknowledge that no online service is completely secure. Usage of the service demonstrates assumption of this risk.
This Agreement shall be governed by and construed in accordance with the laws of the state of New York, without regard to its conflict of law principles. Both parties agree that any legal action or proceeding arising out of or related to this Agreement shall be brought exclusively in the courts of Nassau County, and each party consents to the jurisdiction and venue of such courts.
Boozr reserves the right to make changes or amendments to these terms at any time.
In the event that any of the above terms are violated, Boozr reserves the right to terminate service for the restaurant that is in violation without prior notice.
